Introduction
This Privacy Policy applies to www.goandrace.com website (hereinafter also generically "site") and describes the purpose of the registration service on the site and the method of processing the data entered during registration.
Acceptance of the conditions
The service that www.goandrace.com offers to the User based on the following GENERAL CONDITIONS is
provided by the site owner, who can be contacted at info@goandrace.com.
www.goandrace.com reserves the right to modify the GENERAL CONDITIONS at any time and without notice.
The User can check at any time the current text of the GENERAL CONDITIONS, as updated from time to time by
www.goandrace.com on this page.
www.goandrace.com currently provides registered users with access to a reserved area of the site
which allows the insertion of new running events and the independent management of event information. Both the registration
and the insertion of a running race on www.goandrace.com are completely free. There are no paid services
for the User registered on www.goandrace.com. Unless expressly provided otherwise, the introduction
of any modification to the Service that makes it usable differently compared to its current form, as well as the launch
of new services, will be subject to, and therefore will be regulated by, the GENERAL CONDITIONS. The User acknowledges and
agrees that the Service is provided as it is available at that time and that therefore www.goandrace.com
assumes no responsibility regarding its use and availability.
The Service may be interrupted at any time by the unquestionable decision of the owner of the
www.goandrace.com site.
Registration obligations
In order to start using the Service, the User undertakes to provide his/her email address (hereinafter also "Registration Data") requested during the registration procedure. To verify the accuracy of the email entered, during the first registration phase a message containing a verification link will be sent to the email entered by the User. www.goandrace.com will however have the right to deactivate, temporarily or permanently, the account of the User in question and to prevent any subsequent use of the Service.
Information on the protection of personal data
The Registration Data is collected and used in compliance with Reg. (EU) 2016/679 -GDPR- and the Italian legislation on
the protection of personal data in force. www.goandrace.com informs that:
a) The Registration Data are provided directly by the interested party (User) and are collected and used by
www.goandrace.com, using IT tools and procedures;
b) The purposes pursued by the processing of data, for which the provision is mandatory, under penalty of
impossibility to provide the Service, are directly connected and instrumental to the provision and management of the
Service itself, in accordance with these GENERAL CONDITIONS and include the sole acquisition of the User's e-mail.
Registering with www.goandrace.com does not require the entry of any personal data. The only
information entered during registration is your email address and the choice of a username and password;
c) Only confirmations of the operations performed by the User on www.goandrace.com will be sent
to the e-mail entered by the User during registration, such as, for example, but not limited to, the confirmation of insertion,
modification or cancellation of an event, or the insertion or cancellation of a race route.
d) Except for changes to the current regulation and with the prior consent of the registered Users, no marketing
activities involving the sending of advertising information of any kind to the e-mail registered by the User,
nor market or statistical surveys are envisaged.
e) At any time the interested party may: exercise his rights (access, rectification, cancellation, limitation,
portability, opposition, absence of automated decision-making processes) when provided for in relation to the
data controller, pursuant to articles. from 15 to 22 of the GDPR - Reg. (EU) 2016/679; lodge a complaint with the
Guarantor (www.garanteprivacy.it); and if the processing is based on consent, revoke this consent given, taking
into account that the revocation of consent does not affect the lawfulness of the processing based on consent
before the revocation. To assert these rights, the User can contact the Data Protection Officer directly at the
email address info@goandrace.com.
f) Personal data will be retained as long as the User wishes to continue using the www.goandrace.com
service. On the portal, the possibility of deleting your account on www.goandrace.com is always
guaranteed, an operation which involves the elimination of any registration data from the database.
g) The data controller and data protection officer can be contacted at info@goandrace.com. Pursuant to and for
the purposes of article 6, co.1, letter. a) of the GDPR, by accepting these GENERAL CONDITIONS the User authorizes
www.goandrace.com to collect their personal data, to the subjects, within the limits and for
the purposes indicated in this information.
Account and Password
At the end of the registration procedure for the Service, the User obtains the activation of an account, the use of which is subject to an authentication phase: the User is assigned a username (ID) and password, which constitute the confidential authentication credentials and for which the User himself is solely and exclusively responsible, also with regard to the activities carried out through their use. The User, therefore, undertakes to: a) immediately communicate to www.goandrace.com any unauthorized use of their password, their account as well as any other violation of the security rules of which they become aware; b) log out of your account at the end of each session. c) do not forward emails received from the Service and which may contain quick access links to the service with your account, without prior authentication request. www.goandrace.com cannot in any way be held responsible for any damages resulting from failure to comply with this article. The User is aware that, in order to regulate access to the Service, their authentication depends exclusively on verifying the ID and password used by the User. The User is therefore responsible for the safekeeping and correct use of his/her ID and password to access the Service, as well as for any harmful consequence or prejudice that may arise, to www.goandrace.com or third parties, following the incorrect use of the loss, theft and/or compromise of the confidentiality of the ID and password used by the User. All operations carried out via the ID and password used by the User involve the automatic attribution to the User of the operations carried out and the requests made, without exceptions of any kind. The User acknowledges and acknowledges that www.goandrace.com will always be able to produce, as proof of the operations carried out by the User and - more generally - of the relationships with the User himself, also means of proof obtainable from the IT systems and procedures used by www.goandrace.com to regulate access to the Service.
Rules of user behavior
The User acknowledges that all information, photographs, images, or any other material (hereinafter also "Contents")
transmitted or composed are the sole and exclusive responsibility of the persons from whom such Contents originate. This means
that you, and not www.goandrace.com, are solely and exclusively responsible for any Content you post about
events that you manage on www.goandrace.com. www.goandrace.com cannot in any way
control the Contents transmitted or disseminated through the Service and consequently does not guarantee the lawfulness,
truthfulness, correctness and quality of such Contents. The User undertakes not to use the Service to: a) publish on
www.goandrace.com Content that is illicit, harmful, threatening, abusive, harassing, defamatory and/or
libelous, vulgar, obscene, invasive of the privacy of others, racist, classist or otherwise reprehensible; b) cause harm,
in any way, to minors; c) publish Content on the event page that you do not have the right to transmit;
d) publish Content on www.goandrace.com that involves the violation of patents, trademarks, secrets,
copyrights or other industrial and/or intellectual property rights of third parties (hereinafter also "Rights"); e) publish on
www.goandrace.com material that contains viruses or other code, files or programs designed to interrupt,
destroy or limit the functioning of third party software, hardware or telecommunications equipment; f) illicitly use e-mail
addresses for which you do not have explicit consent to the processing, or have not previously verified their usability;
g) violate, intentionally or unintentionally, any applicable law or regulation.
The User who publishes an event is required to verify the accuracy of the information entered.
www.goandrace.com cannot be held responsible for incomplete, inaccurate or out-of-date information.
You therefore acknowledge that www.goandrace.com does not pre-screen the Content. However,
www.goandrace.com reserves the discretionary right - without assuming any obligation in this regard -
to refuse or remove any Content published on www.goandrace.com. Without prejudice to the foregoing,
www.goandrace.com also reserves the right to remove any Content that constitutes a violation of these
GENERAL CONDITIONS or that is otherwise objectionable. Furthermore, www.goandrace.com is required,
pursuant to Law 38/2006, to inform the competent authorities if they encounter child pornography content. The User agrees to
fully and independently evaluate and bear all risks associated with the use or sharing of Content, including any reliance
placed by the User on the truthfulness, completeness or usefulness of the various Contents. The User acknowledges and
accepts that www.goandrace.com has the right to store the Contents making them publicly visible to
anyone with access to the web both for the normal use of the service offered on www.goandrace.com
and to comply with legal procedures in the event of any violation of these GENERAL CONDITIONS or respond to claims that
the Content violates the rights of third parties. The User acknowledges and agrees that the technical processing,
transmission or dissemination of the Service, including its Contents, may involve: a) the transmission or dissemination
of the Contents in or through other networks; b) the need to make changes in order to conform and adapt such Contents to the
technical specifications of the networks or connection equipment.
Indemnity clause
The User declares and guarantees to indemnify and hold harmless www.goandrace.com as well as the subjects connected to it or controlled by it, its representatives, employees as well as any of its partners from any compensation obligation, including reasonable legal expenses, which may derive from the Contents transmitted, shared or sent by the User, from the use of the Service by the User, from the connection to the Service by the User, to a violation of the rules regulating its use, to a violation of the rights of third parties.
Service changes
www.goandrace.com reserves the right at any time to modify or disable, temporarily or permanently, the Service (or any part thereof), with or without notice to the User. The User acknowledges and agrees that www.goandrace.com cannot in any way be held liable towards the User or third parties for the modification, suspension or deactivation of the Service.
Deactivation of user ID and password - Suspension, service interruption
The User acknowledges and agrees that www.goandrace.com may, in its sole and exclusive discretion, disable the User's password and account or discontinue use of the Service, as well as remove or refuse to disseminate any Content within the Service. By way of example, www.goandrace.com may exercise these rights in the event that the User fails to use the Service or www.goandrace.com believes that the User has violated or acted in a manner incompatible or contrary to the spirit or letter of the GENERAL CONDITIONS. www.goandrace.com also reserves the right, at its sole and exclusive discretion and at any time, to interrupt or suspend the provision of the Service, even without notice. The User acknowledges and agrees that any suspension or interruption of his access to the Service pursuant to the provisions of these GENERAL CONDITIONS may also occur without notice and acknowledges and agrees that www.goandrace.com may immediately deactivate or cancel the User's account and all related information and files in your account and/or deny any further access to such files or the Service. Furthermore, the User acknowledges and agrees that www.goandrace.com shall not be held liable in any way to the User or any other person for the interruption of their access to the Service.
Limitations of www.goandrace.com Liability
The User acknowledges and agrees that www.goandrace.com will in no case be liable for any damages of any kind or nature, including loss of profits, business goodwill or data (even if www.goandrace.com has been advised of the possible occurrence of such damages to Users), resulting from: (i) use or incorrect use of the Service; (ii) the cost of procurement of substitute goods and/or services for the goods and/or services purchased or obtained through the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party. Nothing provided in this contract will have the effect of limiting or excluding www.goandrace.com liability in the event of damages resulting from willful misconduct or gross negligence.
