Terms and Conditions of Service

The service ("Service") offered on goandrace.com ("Site") is provided by AMEI WEB SOLUTIONS (Via Varsavia 24, 50065 Pontassieve (FI), Italy, VAT ID 07297840485, email info@goandrace.com), hereinafter "Owner". By using the Service, the user ("User") agrees to be bound by these Terms and Conditions of Service ("ToS"). The Owner reserves the right to modify the ToS at any time; changes will be effective from the date of publication on the Site. The User is required to periodically check the ToS.

The Site offers registered Users free access to a reserved area that allows them to:

• Insert new running events (races, walks, trails, etc.).
• Modify or delete inserted events.
• Upload GPX files related to their workouts.
• View GPX tracks on a map and analyze performance data.
• Manage their user profile.

There are no paid services for registered Users. Unless otherwise stated, any new features will be subject to these ToS. The Service is provided "as is" and the Owner assumes no responsibility for its use or continuous availability.

To use the reserved area, the User must register by providing a valid email address ("Registration Data") and choosing a username and password. Email verification via a sent link is required. The User guarantees that the Registration Data is correct and up-to-date. The Owner reserves the right to suspend or close accounts with untrue data.

The User is solely responsible for the confidentiality of their username and password and for all activities carried out through their account. The User agrees to: a) immediately notify the Owner of any unauthorized use of their account or security breach; b) log out at the end of each session; c) not share quick access links received via email. The Owner is not responsible for damages resulting from failure to comply with these rules. Authentication is based on ID and password, and all operations performed through them are attributed to the User.

The User is responsible for the content (text, images, GPX files, links) they publish ("Content"). The Owner does not pre-screen Content but reserves the right to remove Content that violates the ToS. The User agrees not to use the Service to:

• Publish unlawful, defamatory, offensive, vulgar, obscene, privacy-invasive, racist, or otherwise objectionable Content.
• Harm minors.
• Publish Content that violates third-party rights (copyright, trademarks, patents, privacy).
• Publish material containing viruses or harmful code.
• Publish non-running events or patently false/misleading information.
• Use the Service for spamming or illegal activities.
• Violate applicable laws or regulations.

The User inserting an event guarantees the accuracy of the information provided (date, location, distance, type, organizer contacts, etc.).

Moderation of content inserted by Users (events, comments if any) occurs manually and after publication. The Owner reserves the unquestionable right to modify, refuse, or remove any Content that violates these ToS, applicable laws, or is deemed inappropriate, without notice.

The Owner reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) at any time, even without notice. The User agrees that the Owner shall not be liable to the User or any third party for such modifications, suspensions, or discontinuations.

The Owner may, at its discretion, deactivate or delete the User's account, discontinue their use of the Service, and remove Content if it believes the User has violated the ToS or used the Service improperly, or due to prolonged inactivity (as specified in the Privacy Policy for GPX data). The User accepts that deactivation may occur without notice and that the Owner will not be liable for the termination of access to the Service.

The User acknowledges that use of the Service is at their own risk. The Owner does not warrant that the Service will meet the User's requirements, nor that it will be uninterrupted, secure, or error-free. The Owner is not liable for:

• Direct or indirect damages arising from the use or inability to use the Service.
• Costs for substitute services.
• Unauthorized access to or alteration of User data.
• Statements or conduct of third parties (including user-generated content or external links).

The Owner's liability is excluded except in cases of willful misconduct or gross negligence.

The User agrees to indemnify and hold harmless the Owner, its representatives, and employees from any claim for damages (including legal fees) made by third parties due to the Content published by the User, the use of the Service, violation of the ToS, or violation of the rights of others.

Personal data provided by the User is processed in accordance with the Site's Privacy Policy. The use of cookies is governed by the Cookie Policy. The User is invited to review them.

These ToS are governed by Italian law. For any dispute concerning the interpretation, execution, or termination of the ToS, the Court of Florence, Italy, shall have exclusive jurisdiction, without prejudice to the mandatory consumer forum, if applicable.
